Intellectual Property & Usage Rights Policy

All content, projects, creative materials, digital assets, and portfolio work displayed on this website are protected intellectual property. These materials may include, but are not limited to, visual designs, videos, audio, copywriting, captions, animations, motion graphics, layouts, concepts, characters, backgrounds, storyboards, scripts, creative directions, production styles, campaign structures, strategic ideas, digital presentation formats, and other related creative assets.

The rights to such materials may belong to Digitalia Studio, the respective client or brand owner, or both, depending on the nature of the project, the scope of work, and the applicable agreement between the parties. Display of any work on this website does not grant any license, ownership right, permission to copy, or permission to commercially use such material.

Ownership of Client and Brand Work

Projects displayed on this website may include work created for or in collaboration with third-party brands, businesses, clients, or organizations. Brand names, logos, product identities, trademarks, business names, and client-specific materials remain the property of their respective owners.

Digitalia Studio may display selected work for portfolio, promotional, marketing, demonstration, or case-study purposes, subject to applicable agreements and permissions. Such display does not transfer rights to any visitor, competitor, agency, individual, or third party. Such use may include Digitalia Studio’s website, social media accounts and channels, third-party portfolio platforms, case studies, proposals, presentations, advertisements, studio showcases, and other online or offline promotional materials.

Digitalia Studio Proprietary Rights

Digitalia Studio retains proprietary rights over its original creative methodology, production approach, design systems, visual treatments, story concepts, storyboard formats, campaign structures, creative ideology, reusable production workflows, character development, scene direction, styling approach, content formats, and studio-developed creative assets, unless expressly assigned in writing.

This includes, but is not limited to, the way concepts are developed, how campaigns are structured, how visuals are styled, how stories are presented, how characters or backgrounds are created, how digital media assets are produced, and how brand communication is transformed into final creative output.

Ownership of Creative Rights, Concepts, and Templates

While the client may receive usage rights to the final approved deliverables according to the agreed scope, payment terms, and applicable project agreement, Digitalia Studio retains ownership of its underlying creative concepts, storylines, scripts, structures, templates, workflows, production methodologies, creative systems, design approaches, storyboard formats, campaign logic, content frameworks, visual treatment methods, and internal production processes, unless expressly assigned in writing.

The client may not reproduce, replicate, reverse-engineer, recreate, copy, adapt, or commission the same creative concept, storyline, structure, campaign idea, visual treatment, production format, content framework, storyboard approach, or studio-developed creative method through another agency, studio, freelancer, internal team, vendor, or third party without written permission from Digitalia Studio.

Exclusivity and Reuse of Creative Methods

Unless specifically agreed in writing, projects created by Digitalia Studio are non-exclusive. Digitalia Studio may use similar creative techniques, design approaches, production methods, visual treatments, campaign structures, content formats, workflows, storytelling methods, production logic, and presentation styles for other clients or projects.

However, Digitalia Studio will not reuse the client’s confidential information, exact branding, trademarks, private materials, final approved visuals, or exact creative execution without permission.

This clause protects Digitalia Studio’s creative freedom while respecting the client’s brand ownership, confidentiality, and project-specific identity.

Restricted Use

No person, business, agency, creator, competitor, organization, or third party may copy, reproduce, imitate, adapt, modify, download, trace, recreate, reverse-engineer, republish, distribute, sell, commercially use, or create derivative work from any content, concept, character, design style, storyline, storyboard, visual treatment, audio-video asset, campaign idea, production format, caption, creative layout, or digital asset displayed on this website without prior written permission from Digitalia Studio and/or the relevant rights holder.

This restriction applies whether the copying is direct, partial, modified, AI-assisted, manually recreated, visually similar, structurally similar, or used as inspiration to produce substantially similar commercial work.

Unauthorized Use & Infringement

Any unauthorized copying, reproduction, imitation, adaptation, modification, republication, commercial use, or derivative use of Digitalia Studio’s protected assets, creative concepts, design styles, characters, storyboards, visual treatments, audio-video assets, campaign ideas, production formats, or studio-developed creative materials shall be treated as an infringement of intellectual property rights.

If any work is found to be copied, recreated, derived from, or substantially similar to assets, concepts, styles, or materials displayed or produced by Digitalia Studio without prior written permission, Digitalia Studio and/or the respective rights holder reserves the right to take legal action. This may include claims for damages, injunctions, removal of infringing material, recovery of legal costs, and any other remedy available under applicable law.

AI-Assisted and Digitally Produced Assets

Some work displayed on this website may involve modern digital production methods, including AI-assisted creative tools, digital compositing, motion design, animation, editing, audio production, and post-production workflows. Regardless of the tools used, the final creative direction, production structure, concept development, visual treatment, composition, editing, scripting, storytelling, and assembled output remain protected creative work.

AI-assisted production does not make any Digitalia Studio asset, concept, campaign, character, storyboard, visual style, or final output free to copy, reuse, imitate, or commercially reproduce.

Third-Party Trademarks and Brand Materials

All third-party brand names, logos, trademarks, product names, and business identities shown on this website remain the property of their respective owners. Their appearance on this website is for portfolio, demonstration, collaboration, or project-reference purposes only.

Digitalia Studio does not claim ownership of third-party trademarks or client-owned brand identities unless specifically created and assigned under a separate agreement.

Enforcement

Digitalia Studio reserves the right to monitor, identify, report, and take action against unauthorized copying, imitation, misuse, reproduction, or commercial exploitation of its protected creative assets and portfolio work.

Where infringement is identified, Digitalia Studio may request immediate removal, issue formal notices, report the violation to hosting platforms, social media platforms, marketplaces, search engines, payment providers, or relevant authorities, and pursue legal remedies where applicable.

No Waiver of Rights

Failure by Digitalia Studio to immediately act against any unauthorized use, imitation, copying, or infringement shall not be considered a waiver of its rights. Digitalia Studio reserves all rights to take action at any time where its intellectual property, creative assets, brand work, client work, or proprietary production materials are misused.
